On September 17, 2008 plaintiffs filed a Complaint against DIRECTV challenging DIRECTV’s imposition of early termination fees against its customers. Plaintiffs claim that, under DIRECTV’s normal procedures, customers never enter into a valid contract agreeing to pay this type of charge. They also claim that, even if customers signed an agreement, the early termination fees constitute illegal punitive damages on customers. Plaintiffs have filed their lawsuit in Superior Court for the County of Los Angeles. The proposed class includes citizens of the State of California who are current or former DIRECTV customers who have paid early termination fees or who may be subject to those fees in the future.

On December 4, 2008, plaintiffs in Ohio filed a similar Complaint against DIRECTV in the United States District Court for the Northern District of Ohio Eastern Division. The proposed class includes citizens of the State of Ohio who are current or former DIRECTV customers who have paid early termination fees or who may be subject to those fees in the future.

CONSUMERS

If you are or were a customer of DIRECTV’s services and you have been assessed an early termination fee or a charge for non-return of equipment or you are currently in dispute with DIRECTV over those types of charges, we would like to hear from you, regardless whether the service was provided in the State of California.

If you have any non-privileged information about the practices of DIRECTV or its installers with respect to providing or failing to provide the terms of so-called agreements to customers, please contact us.
